[insd-2:2025-cv-00249-00008] ENTRY ON PLAINTIFF'S IN FORMA PAUPERIS STATUS - In Mr. Hampton's motion, he reported to the Court that he has struck out. In order for Mr. Hampton to get around the three-strikes barrier and to proceed in forma pauperis, he must assert that he is in imminent danger of serious physical injury as implicated by the allegations in his complaint. Based upon these allegations, Mr. Hampton has met the imminent danger requirement of 28 U.S.C. 1915(g). The plaintiff's motion to proceed in forma pauperis, dkt. [7], is granted. Although the plaintiff is excused from pre-paying the full filing fee, he still must pay the three hundred and fifty dollar ($350.00) filing fee. The assessment of even an initial partial filing fee is waived because the plaintiff has no assets and no means by which to pay a partial filing fee. Accordingly, no initial partial filing fee is due at this time. Signed by District Judge Matthew P. Brookman on 6/27/2025. (Copy to plaintiff via US M |
