2024-04-22 MINUTE entry before the Honorable Steven C. Seeger: On December 12, 2023, this Court granted a motion for a TRO and authorized service of process by email. (Dckt. No. 26) This Court ordered Plaintiff to post a bond, too. Since then, four months have passed, but nothing has happened. Plaintiff has not filed an affidavit confirming service of process. Plaintiff has not posted a bond, either. And Plaintiff has not done anything else to move the forward. Rule 4(m) requires a plaintiff to effectuate service of process within 90 days, and provides that a district court "must" dismiss a case does not meet that deadline. The complaint is dismissed for failure to comply with Rule 4(m), for failure to comply with the order about the posting of the bond, and for want of prosecution. Civil case terminated. Mailed notice.

As an aside, the cut-and-paste operation by Plaintiff's counsel seems to have gone awry in the case at hand. Plaintiff submitted a Word version of a draft TRO to the Court's proposed order inbox at 1:16 p.m. on May 30, 2023. But the TRO for the Bell Sports case included a picture of products by the Emoji company, which is another client. So, the Court deleted the picture in the TRO to avoid confusion. Mailed notice.
