The trademark in question is a specific piece of unique artwork and the alleged infringers are selling similar, in some case indistinguishable, reproductions of this same image with comparable color alterations and words added. Moreover, the infringing products are all signs or posters, and do not take a wide variety of forms. While it is true that the "sameness of the accused products is not enough to establish" proper joinder, when a unique image is altered in a nearly identical fashion, even by over 100 online retailers, the Court can properly infer that there is some connection between these causes of action.
