| 2024-01-23 | ORDER: By an order (Dkt. 5) entered on December 11, 2023, the Court dismissed Plaintiff's complaint because it contained improperly joined claims against improper Defendants. Plaintiff was allowed time to submit an amended complaint but was also warned that failure to do so by January 8, 2024, could result in dismissal of this case. Plaintiff has not submitted an amended complaint to date or otherwise communicated with the Court about this case. It therefore appears that Plaintiff does not want to proceed further. Based on the allegations of the complaint, it appears that a dismissal at this juncture will not prevent Plaintiff from refiling his claims within the two-year statute of limitations. Accordingly, the Court dismisses this case in its entirety without prejudice. See Dorsey v. Varga, 55 F.4th 1094, 1107 (7th Cir. 2022) ("The court may dismiss improperly joined defendants if doing so will not prevent the plaintiff from timely refiling those claims.") |
| 2023-12-11 | ORDER: Plaintiff's application (Dkt. [3]) for leave to proceed in forma pauperis is granted. The Court orders the trust fund officer at Plaintiff's place of incarceration to (1) deduct $34.30 from Plaintiff's account for payment to the Clerk of Court as an initial partial payment of the filing fee; and (2) continue making monthly deductions in accordance with this order. The Clerk of Court is directed to send (electronically, if possible) a copy of this order to the trust fund officer at Plaintiff's present place of incarceration and to this court's fiscal department. Summonses, however, shall not issue, as Plaintiff's complaint (Dkt. [1]) is dismissed without prejudice.
