2025-04-25 MINUTE entry before the Honorable Steven C. Seeger: The Court reviewed Plaintiff's notice of voluntary dismissal (Dckt. No. [28]). Plaintiff seeks to dismiss the case under Federal Rule of Civil Procedure 41(a)(1)(A)(i) because of related litigation in front of the United States Patent and Trademark Office. See Dckt. No. [28], at 1. Rule 41 permits voluntary dismissal by notice "before the opposing party serves either an answer or a motion for summary judgment." See Fed. R. Civ. P. 41(a)(1)(A)(i). But here, Defendants have filed an answer, with a counterclaim to boot (Dckt. No. [22]). So Plaintiff cannot dismiss by notice. Plaintiff can dismiss either by a signed stipulation of dismissal, see Fed. R. Civ. P. 41(a)(1)(A)(ii), or with a court order, see Fed. R. Civ. P. 41(a)(2). To receive an order from this Court, Plaintiffs would have needed to file a motion for dismissal, not a notice of dismissal. So Plaintiff should file a motion if Plaintiff seeks dismissal of the action. That said
