However, the proposed order submitted by counsel imposes discovery obligations upon third-party service providers and defendant in a manner that the court cannot understand. Paragraph one obligates third-party service providers to make certain discovery disclosures. Paragraph two imposes discovery obligations upon defendant, but ¶ 2(c) also requires defendant to list all "the steps taken by Defendant to comply with paragraph 1, (a)-(c)." How the defendant will be able to certify the steps taken by third-party service providers has not been explained and is not obvious.
