| 2025-10-01 | MOTION by Plaintiff Fendi S.R.L. for temporary restraining order |
| 2025-09-22 | MINUTE entry before the Honorable Joan B. Gottschall: Plaintiff's motion to seal [30] its corrected joinder memorandum [31] is granted. The corrected memorandum [31] consists of 25 pages of argument. Counsel is reminded that leave of court is required to file a memorandum exceeding the 15-page limit set by Local Rule 7.1. Having the corrected memorandum of law [31], the court sua sponte grants plaintiff leave to exceed the page limit. The corrected joinder memorandum [31] is taken under advisement. Mailed notice |
| 2025-09-17 | MINUTE entry before the Honorable Joan B. Gottschall: Plaintiff's motion to seal [27] is granted. However, plaintiff's supplemental memorandum [28] regarding joinder appears incomplete. Plaintiff should review the docketed memorandum and, if it is incomplete as it appears, file a corrected memorandum within 7 days, by and including September 24, 2025. If nothing is filed by this deadline, the joinder issue will be taken under advisement. Mailed notice |
| 2025-09-16 | MOTION by Plaintiff Fendi S.R.L. to seal Plaintiffs Supplemental Memorandum Establishing that Joinder is Proper |
| 2025-09-03 | ORDER: In accordance with the accompanying order, plaintiff's motion 14 for a temporary restraining order is denied without prejudice for want of a meaningful, fact-specific analysis of infringement. Plaintiff's motion 13 for leave to serve process electronically is denied without prejudice as premature. Plaintiff may renew its motion for leave to serve process electronically after it has propounded discovery to third parties providing services to defendants. If it wishes to do so, plaintiff has until and including September 17, 2025, to file a memorandum analyzing the propriety of joinder in a defendant-by-defendant manner and cite the page(s) in the record that individually support its contentions as to each individual defendant. Signed by the Honorable Joan B. Gottschall on 9/3/2025.Mailed notice |
| 2025-09-02 | MINUTE entry before the Honorable Joan B. Gottschall: The motion for leave to file under seal 23 is granted. The Clerk is instructed to maintain the seal on all presently sealed documents. Mailed notice |
| 2025-09-02 | SEALED DOCUMENT by Plaintiff Fendi S.R.L. Declaration of Bridgette Wheatley regarding Test Purchases and Personal Jurisdiction |
| 2025-09-01 | MOTION by Plaintiff Fendi S.R.L. to seal Declaration of Mitesh Chauhan regarding Test Purchases and Personal Jurisdiction |
| 2025-08-29 | MINUTE entry before the Honorable Joan B. Gottschall: The affidavit of Nicholas Lambert avers, ¶ 13, that "defendant internet stores. on information and belief, have sold counterfeit Fendi products to residents of Illinois." Dkt. No. 10 ¶ 13. The accompanying screenshots do not include that plaintiffs have purchased any allegedly infringing product or caused such a product to be shipped to an Illinois address. Lambert's averment upon information and belief does not satisfy the evidentiary requirement of personal knowledge and therefore does not carry plaintiff's burden to show a likelihood of success in showing that this court has personal jurisdiction over defendants. See Fed. R. Evid. 602 (personal knowledge required);); Dkt. No. 11 contains screenshots of each defendant's internet stores. There is a "shipping" page but no confirmed orders/ "order confirmation" page. Mailed notice |
| 2025-08-29 | MINUTE entry before the Honorable Joan B. Gottschall: Plaintiff's motion 8 to seal filed August 20, 2025, is granted. The Clerk is instructed to maintain the seal on all presently sealed documents until further order of court. This order does not authorize plaintiff to file any future documents under seal. Plaintiff must show good cause under Local Rule 26.2(c) to file future documents, if any, under seal. While allegations made upon information and belief sometimes make out a prima facie case of personal jurisdiction at the pleading stage, see, e.g., JT's Frames, Inc. v. Casares, 2018 WL 835225, at *4 (N.D. Ill. Feb. 13, 2018), Lambert's conclusory averment fails to do so in the context of this case because the conclusory averment supporting personal jurisdiction is contradicted by the accompanying screenshots. Mailed notice |
