The copyrights in question pertain to a video produced by Plaintiff and used to market their product. Plaintiff accuses Defendants of misappropriating certain still images captured from this promotional video to sell their own products. In relation to Plaintiff's request for provisional injunctive relief, Plaintiff bears the burden of showing a there is a substantial likelihood that Defendants' use of their copyright constitutes illegal copying by establishing the copyrighted work and the infringing work are "substantially similar."
